1. Introduction
- Overview: Welcome to Fitly360, an online platform offering gym services, private classes, and wellbeing, self-care and spas with integrated online payment solutions
- Agreement to Terms: By accessing or using Fitly360, you agree to comply with and be bound by these Terms. We reserve the right to modify these Terms at any time without prior notice.
- Modifications: We reserve the right to modify these Terms at any time without prior notice. Users will be notified of changes through our service or via email, and continued use constitutes acceptance of the revised terms.
2. User Account
- Registration: To access our online services, users must create an account by providing accurate and complete information. Users must promptly update their information when necessary.
- Eligibility: Users must be at least 18 years old or have the consent of a legal guardian to register
- Account Security: Users are responsible for maintaining the confidentiality of their login credentials and are liable for all online activities under their accounts. Users must notify us immediately of any unauthorized use.
3. Online Services Provided
- Description: Fitly360 provides online access to a variety of fitness-related resources, gym services, private classes, and wellbeing, self-care and spas and any activity related thereto.
- Access and Use: Services are accessed online and may require booking through our platform.
4. Payments and Fees (Online Payment Policy)
- Pricing and Billing: Service pricing is displayed online and subject to change. Users will be informed of changes electronically.
- Accepted Payment Methods: Payments can be made electronically using credit/debit cards (visa/ Mastercard) – users will receive payment confirmation via email. Valid billing information must be provided.
- Processing and Security: Payments are processed through secure online gateways complying with necessary required standards. We do not store complete credit card information.
- Failed Transactions: Users must resolve any online payment issues by verifying billing details or contacting their financial institution. Service access may be suspended for unresolved issues.
- Fitly360 will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of the UAE.
5. Paid Service
- Service Plans: Users will find detailed descriptions of online Service plans, including pricing and features.
- Service Activation: An online Fitly360 account and valid payment information are required to activate paid Service. Confirmation is sent electronically.
- Auto-Renewal: Paid Service will not renew automatically. Prior notification is sent electronically.
- Managing Service: Users can adjust Service online through their account dashboard
6. User Conduct
- Prohibited Activities: Users shall not engage in online activities that violate laws, such as unauthorized access or spreading harmful code.
- Compliance: Users must comply with both local and international laws and respect others’ rights online.
- Enforcement: We reserve the right to suspend or terminate accounts for violations without notice.
7. Intellectual Property Rights
- Ownership: All online content, including text, graphics, logos, images, and software is owned by Fitly360 or its licensors and protected by intellectual property laws.
- Trademarks: All online trademarks related to Fitly360 are exclusively owned by Fitly360. Unauthorized use is prohibited.
- License to Users: Users are given a limited, non-commercial license to access and use online content. Content cannot be exploited for commercial gain without consent.
- User-Generated Content: By uploading content online, users grant Fitly360 a perpetual license to use, modify, and distribute across media channels without compensation.
8. Refund Policy
- Conditions for Refund: Refunds are limited to undelivered service and/or billing errors processed online, such as incorrect charges or technical failures attributed to us.
- Non-Refundable Situations: Fitly360 is not liable for refunds under other circumstances involving online services.
- Request Process: Refund requests for online billing errors must be submitted within 5 days, including transaction details.
9. Indemnification
- User Indemnity: Users agree to indemnify and hold Fitly360 harmless against claims arising from their online activities.
10. Termination of Use
- Termination by Us: Fitly360 may terminate user access to online services for breaches or inappropriate conduct.
- User Initiated Termination: Users may terminate accounts via online settings. On termination, all online access and rights cease immediately.
11. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by UAE laws. Legal proceedings related to online services must be commenced in Dubai, UAE.
- Dispute Resolution: Users should resolve disputes through informal online negotiations. If unresolved, disputes may go to binding arbitration in Dubai under DIFC-LCIA rules.
12. General Conditions
- Entire Agreement: These Terms form the entire agreement concerning online use of Fitly360.
- Severability: If any provision is invalid, the rest remain enforceable.
- Waiver: Non-enforcement of any provision does not constitute a waiver.
- Assignment: Users cannot assign their online service rights without written consent.
